What debt defendants need, as a follow up to their discovery, is a strategy. You need to write a letter to “confer” with the other side about these bogus disputes, and then you will need to file a motion to compel discovery. That’s a request to the court to force the debt collector to answer your interrogatories and either provide the requested information and documents or admit they don’t have them.

That’s what the debt collectors don’t want to do. And now you can make them do it without suffering through the mind-numbing routine and confusion of drafting it completely anew. This levels the playing field. At last.

Motions to Compel – What they Are and Why they Work

When you send discovery to a debt collector, you will (eventually) get a response objecting to all, or almost all, of your requests. In the law, this is called “stone-walling.” That is, instead of giving you what you need and what they are required by the law to give, you get a stone wall. The courts don’t really punish this behavior, and it works great as a strategy in most cases against pro se defendants because it wears them out.  In order to get anything, you have to begin and complete an elaborate process of negotiating, writing letters, and ultimately writing a motion to compel and supporting argument – in order to get anything. This is infuriating and obnoxious.

But it contains one of our best ways to beat the debt collector. You can make sure the negotiation process costs the debt collector a lot of money, and you can win the motion to compel, too. It takes work, but this process probably leads to more member victories in our cases than anything else. It’s WHERE you can make suing you unprofitable for them.
